1. Acceptance of Terms

By accessing or using Dental Dash Pro ("Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. These Terms apply to all visitors, patients, dental offices, and other users of the Platform.

2. Description of Services

Dental Dash Pro is an informational platform that helps patients receive treatment estimates and second opinions from licensed dental offices. The Platform does not provide dental services, diagnosis, or medical advice. All treatment estimates provided through the Platform are informational only and must be confirmed during an in-person visit with a licensed dental professional.

3. No Doctor-Patient Relationship

Use of this Platform does not create a doctor-patient relationship between you and Dental Dash Pro, or between you and any participating dental office, unless you separately enter into a formal patient-provider relationship with that office. Nothing on this Platform constitutes professional dental or medical advice, diagnosis, or treatment.

4. Not a HIPAA-Covered Entity

Dental Dash Pro is not a HIPAA-covered entity or business associate. The Platform is not designed, intended, or authorized to transmit, store, or process Protected Health Information (PHI) as defined under HIPAA (45 CFR §160.103). Users must not submit PHI through any form or communication feature on the Platform. Participating dental offices are solely responsible for their own HIPAA compliance and for maintaining the confidentiality of patient records outside of this Platform.

5. User Responsibilities

By using this Platform, you agree to:

• Provide accurate and truthful information when submitting treatment requests.
• Use the Platform only for lawful purposes and in accordance with these Terms.
• Not submit any Protected Health Information (PHI) through the Platform.
• Not impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Not interfere with or disrupt the integrity or performance of the Platform.

6. Treatment Estimates Are Informational Only

All treatment estimates and clinical recommendations provided through the Platform by participating dental offices are informational in nature. They are based on information you provide and are not a substitute for an in-person clinical examination. Final pricing and treatment plans may differ and are subject to change following an in-person evaluation. Dental Dash Pro makes no guarantees regarding the accuracy, completeness, or applicability of any estimate.

7. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, and software, is the property of Dental Dash Pro or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any Platform content without express written permission from Dental Dash Pro.

8. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Dental Dash Pro does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Dental Dash Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Platform, including any reliance on treatment estimates provided through the Platform. Our total liability to you for any claim arising under these Terms shall not exceed fifty dollars ($50.00).

10. Third-Party Links and Services

The Platform may contain links to third-party websites or services that are not owned or controlled by Dental Dash Pro. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services. We encourage you to review the terms and privacy policies of any third-party sites you visit.

11. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the data practices described in our Privacy Policy.

12. Modifications to Terms

Dental Dash Pro reserves the right to modify these Terms at any time. We will notify users of material changes by updating the effective date at the top of this page. Your continued use of the Platform after any such changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

13. Termination

Dental Dash Pro reserves the right to suspend or terminate your access to the Platform at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, all provisions of these Terms that by their nature should survive termination shall continue to apply.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona.
